    This position ensures the agency manages any issues regarding privacy with expedience and accuracy. This person responds to privacy inquiries and incidents, manages data governance including oversight of an associated subcommittee, and updating privacy practices and procedures. The ideal candidate will work well independently as a subject matter expert navigating complex privacy legal areas with HCA staff.     About the division:
    The Division of Legal Services is within the Central Services Administration and provides support to all agency divisions at all employee levels to mitigate risks, comply with changing laws, and assist the agency in accomplishing its goals.
     
    The Privacy Office is managed by the Privacy Officer and is located with the Division of Legal Services’ Enterprise Risk Management Office, which is also responsible for managing the agency’s enterprise risk management program, public records disclosure program, litigation discovery coordination program, records retention program, and internal control program. The Privacy Manager reports to the Privacy Officer.
     
    About the position:
    The Privacy Manager provides expert level advice and support on privacy and confidentiality matters and makes independent review of all aspects to the agency’s compliance with HIPAA and other confidentiality laws. This position provides support and advice to the agency’s Privacy Officer regarding planning, leading, and strategically managing a reliable and legally compliant privacy program.
     
    They also conduct outreach and participate in major HCA projects to ensure that the agency and its employees follow state and federal privacy and confidentiality requirements. They advise on policy and procedure decisions about privacy and confidentiality and have the flexibility to apply those policies and procedures to the best advantage of the agency. The position works with other divisions to ensure privacy compliance and best practices are embedded in all stages of the data life cycle, including data intake, data access, data sharing, vendor monitoring, and data retention and destruction.
     
    This position is eligible to telework and is typically not required to report on-site. The default assigned work location of all Health Care Authority (HCA) positions – both on-site and telework eligible positions – is within the State of Washington. Frequency of onsite work will vary based on business and operational needs. HCA may choose, but is not required, to support out-of-state telework on a case-by-case basis.
    Some of what you will do:
    • Assist Privacy Officer in all aspects of administering HCA’s privacy program.
    • Provide an advanced level of expertise to the agency on state and federal privacy and confidentiality requirements.
    • Create and conduct continuous training of HCA’s workforce on state and federal privacy and confidentiality requirements.
    • Draft, implement, and maintain appropriate privacy documentation and guidelines, including policies, procedures, and notices of privacy practices.
    • Advise the Privacy Officer on the agency’s implementation of changes in privacy laws and agency rule adoption.
    • Resolve questions, comments, and complaints related to privacy and confidentiality matters.
    • Oversee and monitor privacy and confidentiality issues to resolution and document actions taken.
    • Investigate privacy and confidentiality complaints concerning HCA and resolve them when possible.
    • Recommend, develop, implement, and oversee corrective action and mitigation efforts to address deficient practices and improve compliance. 
    • When required, facilitate required notifications for the Office for Civil Rights, members and clients, the media, and the Washington State Attorney General’s Office.
    • Assess HCA risk and plan for long range agency privacy and confidentiality compliance.
    • Serve as a resource and subject matter expert on interagency privacy workgroups and projects.
    • Give professional presentations and write professional publications on areas of expertise.
    • Analyze bills, legislation, and proposed and final rules for the agency.
     
    Required qualifications:
     
    Qualifying candidates will satisfy both of the following qualifications:
    • Juris doctor degree from ABA-accredited law school.
    • Demonstrated experience and expertise in analyzing, interpreting, and applying rules, laws, and case law.
     
    Required competencies:

    Ability to:
    • Interact with and present to executive management to implement compliance strategies and action plans.
    • Communicate clearly and effectively with all levels of agency employees, including ability to gather appropriate information and provide understandable and actionable advice.
    • Recognize, plan, and integrate changes impacting privacy and client confidentiality and to provide sound advice where law is unclear, changing, or nonexistent.
    • Conduct comprehensive investigations and skill in reaching reasoned decisions.
    • Conduct analysis in complex areas involving privacy and the Public Records Act.
    • Act quickly and efficiently in emergent situations.
    • Handle customer service questions and complaints in a pleasant and professional manner.
    • Draft legal documents, correspondence, rules, and policies.
    Skills:
    • Understand, interpret, and apply legal standards.
    • Analyze and develop policies.
    • Strong written and verbal communication skills, including plain talk principles.
    • Effectively work with the Office of the Attorney General.
    • Conduct legal research, effectively analyze information, and formulate appropriate policies and recommendations.
    • Assess risk and design mechanisms to mitigate risk.
     
    Preferred qualifications:
     
    • At least one (1) year of experience with privacy and confidentiality.
    • Privacy certification such as Certified Information Privacy Professional (CIPP) or Certified in Healthcare Privacy and Security (CHPS).
    • Demonstrated knowledge of and experience with state and federal privacy laws.
    • Knowledge of data privacy and governance principles.
    • Experience reviewing and drafting data sharing and business associate agreements.
    • Knowledge of the federal rulemaking process and Washington state legislative and rulemaking processes.
    • Experience analyzing, drafting, or editing legislation.
    • Demonstrated ability to problem-solve, prioritize work, meet deadlines, and provide independent strategic direction/decision making.
    • Give the appropriate attention to detail and accuracy, has a commitment to excellence, strives for continuous quality improvement.
    • Ability to clearly communicate complex information, verbally and in writing to a non-technical audience.
    • Ability to work with diverse groups of people and work collaboratively with others.
